These Terms of Service ("Terms") govern all purchases, content submissions, social media interactions, and use of websites and programs offered by Onoma LLC, doing business as Kindred Robotics ("Kindred Robotics," "we," "us," or "our") (collectively, the "Services"). By placing an order, submitting content, or otherwise using the Services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old to make a purchase, submit content, or otherwise enter into these Terms. If you are under 18, you may use the Services only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf and takes responsibility for your use. By using the Services, you represent that you meet these requirements.
2. Purchases
All purchases are subject to the pricing, availability, and shipping information shown at checkout. Kindred Robotics reserves the right to limit quantities, refuse or cancel orders, and correct pricing or listing errors. Specific products or programs (such as pre-launch or crowdfunding offers) may have additional terms, set out in Section 12 below or in the program's own communications.
3. Content Submission & Social Media
From time to time, Kindred Robotics may invite you to submit photos, videos, reviews, or posts ("Content") — whether as part of a specific program, a giveaway, or general engagement with us on social media (e.g., tagging us or using our hashtags). Kindred Robotics has sole discretion to determine whether submitted Content qualifies for any associated reward, and may decline Content that is incomplete, low-quality, or doesn't reasonably reflect the relevant product or request.
4. Content License Grant
By submitting Content to Kindred Robotics or tagging us in a public post, you grant Kindred Robotics a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, repost, distribute, display, and create edited or excerpted versions of your Content — including on our website, social media, advertising, crowdfunding pages, and marketing materials — with credit to you (e.g., your name or handle) where reasonably practical. You retain ownership of your Content; this license does not transfer ownership, and you're free to continue using or posting it yourself.
You confirm that you own the Content or otherwise have the rights to grant this license, and that it doesn't infringe on anyone else's rights (including third parties who may appear in the Content).
5. Intellectual Property
Our IP. The Kindred Robotics and Onoma names, logos, and branding, along with our website content, product designs, documentation, firmware, and software, are owned by Onoma LLC (dba Kindred Robotics) or our licensors and are protected by intellectual property laws. Except for the limited license below, nothing in these Terms transfers any ownership or grants you any right to use our trademarks, branding, or IP without prior written permission.
Your license to use the kit. When you purchase a Kindred Robotics kit, we grant you a personal, non-exclusive, non-transferable license to use the included hardware and software, and to modify both, for personal, non-commercial purposes only. The software and firmware are licensed under the PolyForm Noncommercial License 1.0.0 (https://polyformproject.org/licenses/noncommercial/1.0.0); the same non-commercial restriction applies to any modifications you make to the hardware or its design.
What's not allowed. You may not use our products, software, firmware, or designs to manufacture, sell, distribute, or otherwise commercialize competing or derivative products; resell or redistribute the software or designs for commercial purposes; remove or alter proprietary notices; or use our trademarks or branding without written permission. "Commercial purpose" means use primarily intended for or directed toward commercial advantage or monetary compensation.
6. Assumption of Risk
Kindred Robotics products are robotics kits and related electronics involving assembly and physical/electronic components. You acknowledge that assembly and use carry inherent risks, and that you are responsible for following included instructions and safety guidance. Kindred Robotics is not liable for damages, injury, or losses arising from misuse, improper assembly, or failure to follow provided instructions.
7. Limitation of Liability
To the maximum extent permitted by law, Kindred Robotics' total liability arising from your purchase, your participation in any program, or use of the Services is limited to the amount you paid. Kindred Robotics is not liable for indirect, incidental, or consequential damages.
8. Indemnification
You agree to indemnify and hold harmless Onoma LLC (dba Kindred Robotics) and its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your misuse of the Services or products, your violation of these Terms, or Content you submit — including any claim that your Content infringes the rights of, or caused harm to, a third party.
9. No Warranty Beyond What's Stated
Products are provided without additional warranties, express or implied, except as explicitly stated elsewhere (e.g., a written warranty or refund policy for a specific product or program).
10. Force Majeure
Kindred Robotics is not responsible for delays or failures to perform — including delays in production, fulfillment, or shipping — caused by events beyond our reasonable control, such as supply chain disruptions, manufacturing delays, natural disasters, labor shortages, shipping carrier issues, or other circumstances we could not reasonably prevent. This is particularly relevant for pre-launch and crowdfunding-funded products, where timelines are estimates and may shift.
11. Changes & Disputes
Kindred Robotics may update these Terms from time to time; changes will apply to purchases or submissions made after the update.
Governing law. These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
Dispute resolution. Any dispute arising out of or relating to these Terms or the Services will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, seated in King County, Washington. Arbitration will be conducted by a single arbitrator, and judgment on the award may be entered in any court of competent jurisdiction.
Notwithstanding the foregoing, either party may bring an individual claim in small claims court if it qualifies under that court's jurisdictional limits, and Kindred Robotics may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or enforce the Content license granted under these Terms.
Any arbitration will be conducted on an individual basis only; class, collective, or representative actions are not permitted.
12. Program-Specific Terms
Certain Kindred Robotics products or campaigns may have additional terms specific to that program. Where applicable, those terms supplement (and in case of conflict, take precedence over) the general Terms above for that program only.
12.1 Casper Early Access Program
This early access offer allows waitlist members to order Casper at full retail price ($200) ahead of public launch. Participation in the content cashback program is optional. Cashback amounts, tiers, and deadlines are as described in the offer communication you received and may be updated by Kindred Robotics at any time before a given submission is made. Cashback is issued only after Kindred Robotics reviews and confirms that submitted Content meets the program guidelines (visible on a public platform, tags/hashtags included, product clearly shown).
13. General
If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with any program-specific terms and policies referenced here, are the entire agreement between you and Kindred Robotics regarding the Services. You may not assign or transfer your rights under these Terms; we may assign ours in connection with a merger, acquisition, or sale of assets.

Information We Collect
Information you provide:
Contact and order details — name, email address, shipping address, and phone number when you join a waitlist, place an order, or contact us.
Payment information — processed by our payment provider (Stripe). We do not store full card numbers; Stripe handles payment data under its own privacy and security terms.
Content and social details — videos, photos, posts, and the social media handles or links you share with us as part of a program or submission.
Information collected automatically:
Basic device and usage data (such as IP address, browser type, and pages visited) and cookies or similar technologies used to operate and improve our website and understand traffic.
How We Use Your Information
We use your information to process and fulfill orders, ship products, process payments, run and verify content/cashback programs, respond to inquiries, send order updates and (where you've opted in) marketing communications, operate and improve the Services, and comply with legal obligations.
How We Share Your Information
We do not sell your personal information. We share it only with:
Service providers who help us operate — for example, Stripe (payments), shipping carriers, email and analytics providers — limited to what they need to perform their service.
Legal and safety recipients when required by law, to enforce our Terms, or to protect our rights, users, or the public.
Business transfers — if Onoma LLC is involved in a merger, acquisition, or sale of assets, your information may transfer as part of that transaction.
Cookies
Our website may use cookies and similar technologies to keep the site functioning, remember preferences, and measure traffic. You can usually control cookies through your browser settings, though disabling them may affect how the site works.
Data Retention
We keep your information for as long as needed to provide the Services, fulfill orders, run programs, and meet legal, tax, and accounting requirements, then delete or anonymize it when it's no longer needed.
Your Choices and Rights
You can opt out of marketing emails at any time using the unsubscribe link or by contacting us. Depending on where you live (for example, California or other states with privacy laws), you may have rights to access, correct, or delete your personal information, or to opt out of certain data practices. To make a request, contact us at the email below; we'll respond as required by applicable law.
Children's Privacy
The Services are intended for adults (18+). We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.

We may update this Privacy Policy from time to time. Material changes will be reflected by updating the "Last updated" date above.
